Governing version: The Korean-language version of this document is the governing version; in the event of any discrepancy in interpretation between the Korean version and a translated version, the Korean version prevails.
These Terms are provided separately from the Privacy Policy pursuant to the Act on the Protection and Use of Location Information ("Location Information Act"). Where the general provisions of the Privacy Policy conflict with these Terms, these Terms prevail with respect to the processing of location information.
1. Purpose
These Terms are intended to set out the rights, obligations, and responsibilities between Zero to Zenith Co., Ltd. ("Company") and users in connection with the collection, use, and retention of personal location information by the RUNMON app ("Service") operated by the Company.
2. Effect and Amendment of These Terms
- These Terms take effect when a user agrees to them in order to use location-based features within the Service.
- The Company may amend these Terms within the bounds of the Location Information Act and other applicable laws.
- When amending these Terms, the Company will give notice — stating the reason for and the effective date of the amendment — by in-app notice or email at least 7 days before the effective date.
- If a user continues to use the Service without objection after the effective date of the amended Terms, the user is deemed to have agreed to the amendment.
3. Content, Name, and Fees of the Location-Based Service
| Service | Description |
|---|---|
| Server Backup | A service that stores run records (including GPS routes) recorded by the user's device during a run on the Company's servers, so that the records can be restored even if they are lost from the device (device change, loss, app reinstall, etc.), and so that features based on the server-stored run records can be used. |
| Location-based running-broadcast list | A feature that, on the app's main screen, selects and lists running broadcasts that are in progress or newly starting within a certain radius of the user's current location, and allows the user to join such a broadcast or to host one. Showing the running-broadcast list based on location is a core feature of the app; if the user hosts a running broadcast, the location at the time of hosting is used as the reference location for that broadcast. |
Information stored for Server Backup
- Personal location information — the following values for each point that makes up the GPS route:
- latitude, longitude, altitude
- the time each point was measured
- speed of movement
- location accuracy (margin of error based on satellite signal)
- Information stored together as part of the run record:
- heart rate and cadence measured at each point
- run summary information: total distance, elapsed/moving time, run start time, cumulative elevation gain/loss, average/best pace, calories burned, and other metrics the device derives from the GPS route
- segments during the run that the device automatically detected as travel by car, bicycle, or similar and excluded from pace/distance calculations (the detected mode of transport and the start/end time of each such segment)
- a run place name that the user enters or selects
- if the run was in broadcast mode, the account identifiers of other users who participated in the same run (used to display the participant list)
The latitude, longitude, and altitude in item 1 above are encrypted when stored on the server. For details such as the purpose of use and retention period of each type of information, see the Privacy Policy.
Detailed features provided on the basis of Server Backup may be added or changed in accordance with in-app notices. However, if such a feature would use personal location information beyond the purpose and scope set out in Article 4, or would provide it to a third party, the Company will obtain separate consent from the user in accordance with Article 4.
Information processed for the location-based running-broadcast list
- The user's current location (latitude, longitude) at the time the user views the running-broadcast list or hosts a running broadcast in the app.
- This location is processed as follows:
- It is transmitted to the server and used only as the reference point for radius-based filtering of the broadcast list; the user's location coordinates are not provided to other users. Other users are shown only the broadcast list after radius filtering.
- Only the single most recent location per user is retained on the server, updated on the next location transmission; temporarily stored copies are automatically deleted after a certain period (currently 1 hour).
- If the user hosts a running broadcast, the location at the time of hosting is stored as the reference location for that broadcast and retained until the broadcast ends.
- Showing the running-broadcast list based on location is a core feature of the app; location is transmitted when the user uses the broadcast-list screen or hosts a running broadcast. If device location permission is not granted, this feature cannot be used.
Fees
- The location-based service is currently provided free of charge. However, there is a limit on the volume of run records that can be stored via Server Backup; volume exceeding the free limit may be stored by subscribing to a paid plan to increase the storage limit, or within the space freed by deleting previously stored records. The free storage limit and the per-plan storage limits are available in in-app notices and on the plan detail pages.
- Payment, renewal, refunds, and the like for paid plans are governed jointly by the paid-services and payment provisions of the Terms of Service and by the policies of the app marketplace in use (App Store, Google Play). A user on the free tier may continue to use the Service within the scope provided free of charge unless they subscribe to a paid plan.
- The Company may change the free storage limit or the composition and pricing of paid plans, or add new paid features; in that case it will give advance notice of the content and effective date by the method set out in Article 2(3). The fees and conditions of a subscription period already paid for are maintained until that period ends, and a changed fee applies from the next renewal. Notice, consent, and cancellation regarding fee changes are governed by the paid-services and payment provisions of the Terms of Service.
- Data communication charges arising in the course of collecting and transmitting location information are subject to the policy of the mobile carrier the user has subscribed to.
4. Collection, Use, and Provision of Personal Location Information
- The Company collects personal location information recorded during a run, with the user's consent, only when the user has turned on Server Backup. If Server Backup is not turned on, that location information is stored only on the device and is not transmitted to the Company's servers.
- Showing the running-broadcast list based on location on the app's main screen is a core feature of the app. When a user views the running-broadcast list or hosts a running broadcast in the app, the Company collects the user's current location (latitude, longitude) at that time, on the basis of the user's agreement to these Terms and the grant of device location permission. This location is used only for radius-based filtering of the broadcast list and for setting the reference location of a hosted broadcast; only the single most recent location per user is retained on the server, updated on the next transmission, and temporarily stored copies are automatically deleted after a certain period (currently 1 hour). If the user hosts a running broadcast, the location at the time of hosting is stored as the reference location for that broadcast and retained until the broadcast ends. If device location permission is not granted, this feature cannot be used.
- The Company uses collected personal location information only for the purposes in paragraphs 1 and 2 (backing up and restoring run records and providing features based on them; providing the running-broadcast list based on location) and within the scope for which the user has given consent after prior notice (service improvement, etc.). However, using personal location information for statistical purposes after pseudonymization (coordinate generalization, separate storage of identifying information, etc.) may be carried out without additional consent separate from this consent, pursuant to Article 28-2 of the Personal Information Protection Act.
- The Company does not provide personal location information to third parties without the user's prior consent. A request by an investigative agency based on law is an exception; even then, the Company will make reasonable efforts to notify the user to the extent permitted by the Location Information Act.
- The Company notifies users that, to other users who participated in a run (broadcast) together, the participant list (nickname, profile picture) may be displayed on that run-record screen. This is displayed by referencing the participant's own account information in real time, and detailed location information such as location coordinates is not shared among participants. Likewise, when viewing the running-broadcast list, other users are provided only the broadcast list after radius filtering, and a user's location coordinates are not provided to other users.
- Pursuant to Article 16(2) of the Location Information Act, the Company automatically records, in the location information system, data that can verify the fact of collection, use, and provision of personal location information (the "verification data"); its retention period is as set out in Article 5.
5. Rights of the Personal Location Information Subject
Users have the following rights and may exercise them at any time through the app settings or the contact below:
- Withdraw, in whole or in part, consent to the collection and use of personal location information for Server Backup and for the location-based running-broadcast list (by turning off Server Backup in app settings, or by revoking device location permission).
- Request access to, or notification of, the verification data on the collection, use, and provision of personal location information.
- Request correction of erroneous personal location information.
- Request the complete cessation and destruction of personal location information processing by withdrawing membership.
If a user withdraws consent to Server Backup, the Company destroys without delay the user's personal location information stored on the server (running GPS routes). The most recent location retained for the running-broadcast list is no longer updated once location permission is revoked, and temporarily stored copies are deleted according to the automatic deletion cycle in Article 4(2). In that case, the user also cannot use the features of viewing the running-broadcast list based on location or joining or hosting running broadcasts. However, the verification data in Article 4(6) is retained separately for 3 years from the date each record is created, for responding to location-related disputes and for statutory record retention, and is then destroyed. If a dispute, investigation, or inquiry related to a record is ongoing, it is retained until that concludes.
6. Personal Location Information Manager
To manage personal location information safely and to handle complaints from personal location information subjects smoothly, the Company designates and operates a person in a position to take actual responsibility as the Personal Location Information Manager.
- Name: Yujin Cho
- Title: CEO
- Email: team.zerotozenith@gmail.com
The manager's affiliation and other contact details are as set out in Article 10 (Company Contact).
7. Compensation for Damages
If the Company causes damage to a user through an act that violates Articles 15 through 26 of the Location Information Act, the user may claim compensation from the Company. In such a case, the Company cannot be relieved of liability unless it proves the absence of intent or negligence.
8. Disclaimer
The Company is not liable for damage arising to a user where it cannot provide the Service due to any of the following, absent intent or gross negligence:
- A natural disaster or comparable force majeure event.
- A disruption to Service use caused by the fault of the user or a third party.
- Inaccurate location information collection due to the user's device or communication environment (poor GPS reception, etc.).
9. Dispute Mediation, etc.
- Where consultation between the parties is not reached or cannot be had regarding a location-related dispute, a user or the Company may apply for mediation to the Personal Information Dispute Mediation Committee (kopico.go.kr / 1833-6972), pursuant to Article 28(2) of the Location Information Act and the Personal Information Protection Act.
- Where consultation between the parties is not reached or cannot be had regarding a location-related dispute, the Company may apply for adjudication to the Korea Communications Commission (kcc.go.kr), pursuant to Article 28(1) of the Location Information Act.
- A user may report an infringement of personal location information to the Personal Information Infringement Report Center (privacy.kisa.or.kr / 118).
