Governing version: The Korean-language version of this document is the governing version; in the event of any discrepancy in interpretation between the Korean version and a translated version, the Korean version prevails.
1. Purpose and Scope
These Terms of Service ("Terms") set out the rights, obligations, and responsibilities relating to your use of the RUNMON app and related services ("Service") provided by Zero to Zenith Co., Ltd. ("Company," "we," "us"). RUNMON is the brand name under which Zero to Zenith Co., Ltd. operates this Service. By creating an account or using the Service, you are deemed to have agreed to these Terms.
2. Definitions
| Term | Meaning |
|---|---|
| Service | The RUNMON app and all related features provided by the Company |
| User | A person who agrees to these Terms and uses the Service |
| Channel | A broadcast space that provides real-time voice communication |
| Account | The identifying information a User creates in order to use the Service |
3. Effect and Amendment of These Terms
- These Terms take effect when a User agrees to them upon signing up for the Service.
- If we amend these Terms, we will give notice by in-app notification or email at least 7 days before the effective date.
- If you do not agree to the amended Terms, you may object by withdrawing from the Service. If you continue to use the Service after notice, you are deemed to have accepted the amended Terms.
4. Eligibility
- You must be at least 18 years of age to use the Service. By creating an account, you represent that you are at least 18. Accounts found to belong to users under 18 will be restricted.
- We may refuse a registration request or terminate the agreement where a User:
- impersonates another person;
- has previously been subject to a usage restriction;
- registers false information; or
- otherwise violates these Terms or applicable law.
5. Your Account
- You are responsible for maintaining the security of your account credentials.
- Your account is personal and may not be shared with or transferred to others.
- If you suspect unauthorized use of your account, notify us immediately at team.zerotozenith@gmail.com.
- We are not responsible for losses resulting from your failure to secure your account.
- You may delete your account and terminate the Service agreement at any time from the app's settings. Your data will be handled in accordance with our Privacy Policy upon deletion.
6. The Service
The Company provides the following features:
- Creating and joining real-time voice broadcasts
- Voice communication among broadcast participants
- Location-based channel discovery (within a set radius of your current location)
- Reporting and blocking of participants
- Differentiated features by subscription plan
Feature availability and specifications may change over time.
7. Voice Broadcasts
- Audio in broadcasts is transmitted in real time between participants and is not recorded or stored on any server.
- Participants in a broadcast are divided into two types:
- Broadcast Host: The user who created the broadcast. The host has full authority to manage the broadcast, including adjusting participant roles, muting participants, and removing participants.
- General Participant: Holds a speaker (can publish audio) or audience (listen-only) role, or both, as granted by the host. Roles may be changed by the host at any time.
- You are solely responsible for your speech and conduct within broadcasts. We do not pre-screen real-time voice content.
8. Your Responsibilities
You must:
- Comply with these Terms and all applicable laws
- Follow our Community Guidelines
- Not infringe the rights of others (defamation, copyright infringement, unauthorized collection of personal information, etc.)
- Not interfere with operation of the Service (abnormal access, automated programs, imposing excessive load on servers, etc.)
- Not register false information or misappropriate another person's information
- Not share illegal content during a broadcast, or threaten or harass others
9. Content and Intellectual Property
- All software, design, trademarks, and logos in the Service belong to RUNMON.
- You retain ownership of content you create within the Service (e.g., your nickname). By using the Service, you grant us a non-exclusive, royalty-free license to display and transmit your content solely for the purpose of providing the Service.
- You may not reproduce, distribute, or commercially exploit the Service without our prior written consent.
10. Paid Services and Payment
- Subscription plans are offered through your app marketplace's in-app purchase system — Apple In-App Purchase on iOS, Google Play Billing on Android.
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date via your app marketplace's subscription settings (App Store or Google Play).
- Billing period: Subscription periods are calculated from the exact moment of original purchase (e.g., a monthly subscription purchased at 11 PM on July 15 renews at approximately 11 PM on August 15 — not at midnight). End-of-month edge cases and other details follow your app marketplace's rules (Apple or Google).
- Access on cancellation: Cancelling a subscription does not immediately terminate access. You retain access to the paid tier until the end of the current billing period.
- Refunds: Billing and refunds are handled in accordance with your app marketplace's policies (Apple or Google). Refund requests must be submitted directly through that marketplace. We do not independently process refunds for in-app purchases. If service is unavailable due to our fault, please contact us separately.
- Subscription upgrades and downgrades are subject to your app marketplace's proration and billing rules.
- Pricing, billing cycles, and plan details are displayed at sign-up and on each plan's page in the App Store or Google Play.
- Price changes: If we change a subscription price, the new price does not affect any period you have already paid for and applies from your next renewal. We will notify you in advance of the renewal to which the new price applies, by in-app notice or email, and you may cancel before that renewal to decline the new price. Where required by your app marketplace (Apple/Google), a price increase takes effect only with your explicit consent; if you do not consent, the subscription is not renewed and expires at the end of the current period.
11. Usage Restrictions and Account Sanctions
- If you violate these Terms or the Community Guidelines, we may take action — including warnings, feature restrictions, account suspension, or permanent termination — in accordance with the procedures set out in the Community Guidelines.
- Where serious unlawful conduct is confirmed, we may report it to the relevant authorities.
- If you object to an action, you may use the appeal procedure specified in the Community Guidelines.
12. Change, Suspension, and Termination of the Service
- We may modify or temporarily suspend the Service for operational or technical reasons.
- If we discontinue the Service entirely, we will provide at least 30 days' notice via in-app notification or email.
- We are not liable for service interruptions caused by force majeure events such as natural disasters, infrastructure outages, or government action.
13. Disclaimers and Limitation of Liability
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted or error-free operation.
- We are not responsible for disputes between users or for harm arising from speech or conduct within broadcasts.
- To the extent permitted by applicable law, our aggregate liability for any claim arising from these Terms or your use of the Service will not exceed the amount you paid us in the 12 months preceding the claim.
14. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles.
- Disputes relating to use of the Service are, in principle, resolved through consultation between the parties.
- Failing consultation, the court with jurisdiction over the location of the Company's headquarters has exclusive jurisdiction. For jurisdiction-specific provisions, see the Addenda below.
- Notwithstanding paragraphs 1 and 3, if you are a consumer, you keep the protection afforded to you by those provisions of the consumer-protection law of the country of your habitual residence that cannot be derogated from by agreement. Where that law gives you the right to bring proceedings before the courts of your place of residence, paragraph 3 does not restrict that right.
15. Copyright Infringement
If you believe content within the Service infringes your copyright, please send a notice to team.zerotozenith@gmail.com including:
- Your signature (physical or electronic)
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and where it appeared (e.g., broadcast channel name, date and time)
- Your contact information (email and/or phone number)
- A statement that you have a good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf
We will review notices in good faith and take appropriate action. Note that because voice broadcasts are not recorded or stored, removal of content from a broadcast that has already ended may not be possible.
16. Privacy and Data Use
- Your personal information is processed in accordance with our Privacy Policy.
- Fitness data generated through your use of the Service (distance, pace, step count, etc.) may be used for service improvement, personalized feature development, and anonymized statistical analysis.
- Fitness and health data will not be used for advertising, marketing, or third-party data sales purposes.
17. Apple
These Terms are an agreement between you and Zero to Zenith Co., Ltd., not with Apple.
- Apple bears no warranty obligation whatsoever with respect to the Service or its content.
- Responsibility for maintenance, support, and warranty of the Service lies with Zero to Zenith Co., Ltd., not Apple.
- Responsibility for addressing any third-party claim that the Service infringes intellectual property rights lies with Zero to Zenith Co., Ltd., not Apple.
- Apple is a third-party beneficiary of these Terms and, if you violate these Terms, has the right to enforce them directly against you.
18. Account Deletion and Data Retention
- Deletion Request: You may request account deletion at any time from the app's settings.
- Grace Period: Your account is immediately deactivated upon deletion request. A 30-day grace period applies, during which you cannot use the Service.
- Cancellation During Grace Period: You may cancel your deletion request at any time during the 30-day grace period by logging in again with the same social account. Your account will be automatically restored upon login.
- Completion of Withdrawal: After 30 days, the withdrawal is finalized and cannot be undone. At that point, personal identifiers are removed as follows:
- Deleted: Email address, social login identifiers, profile image, and last active location.
- Nickname: Changed to an anonymous nickname.
- Retained: Gender, country, and stated purposes of use — retained as anonymous statistical data with no personal identifiers attached.
- Re-registration: After withdrawal is finalized (30 days), you may re-register with the same social account, but all previous data will have been deleted and you will start as a new account. During the grace period, logging in with the same social account cancels the withdrawal and restores your existing account.
- Service Records: Report history you submitted about other members (used as evidence for sanctions against them) is retained for the duration of the Service's operation for fraud prevention and service management. Your broadcast participation history and reports filed against you are deleted upon withdrawal.
- Subscription and Auto-Renewal: If you have an active paid subscription, please cancel it in your app marketplace (App Store or Google Play) before requesting account deletion. No refund will be provided for remaining subscription time upon account deletion.
19. Miscellaneous
- Matters not specified in these Terms are governed by applicable law and commercial custom.
- If any provision of these Terms is held invalid, the validity of the remaining provisions is not affected.
